Before I get to the details of this constitutional crime, let me say that America deserves a better conservative candidate than Donald Trump. The tragedy of Trump is that he is saying so many of the right things and is such a total boor in expressing them. I believe it was George Will who first pointed out Trump’s association with Vince McMahon of World Wrestling Entertainment, and remarked that Trump is operating on that same dumbed-down WWE level.
Despite my extreme contempt for Trump, he is still an American citizen, with First Amendment rights. Except in West Hollywood, where Mayor Lindsey Horvath has decided otherwise. In a recent letter to the Washington Examiner, Ms. Horvath stated, “With the primary making its way to California, as West Hollywood’s Mayor, I want to make very clear that your campaign of violence and intimidation is not welcome in our City.”
Then the Mayor went far beyond her Constitutional right to criticize a political opponent; she crossed all legal lines and outright banned Trump from campaigning in West Hollywood, or WeHo, as it is commonly called.
Horvath instructed City staff that they can refuse to issue special event permits to Trump, if he attempts to schedule a rally in WeHo, and claimed in the same letter to the Examiner that such actions are well within their rights. Attempting to justify the unjustifiable, she said, “As Mayor of West Hollywood, it is my primary responsibility to keep our community safe.”
Horvath also wrote an op-ed for The Advocate, a leading LGBT magazine. In it, she said, “From mocking people living with disabilities to classifying entire ethnicities as violent criminals to persecuting specific religious communities, Trump has pursued headlines in this election season with reckless abandon.” She is certainly entitled to that opinion, and I even share parts of it. But she is not, repeat, not, entitled to state that Donald Trump, an American citizen, has “gone beyond [his] right to express a political point of view or policy differences.”
Naïve, embarrassing, and illegal as this this position is, Ms. Horvath didn’t keep it to herself. Evidently, she wrote an open letter to 87 other mayors bragging about her actions, and encouraging them to do the same.
For the benefit of Ms. Horvath, and every other progressive who has forgotten the Number 1 Right in the Bill of Rights, here is the entire text of the First Amendment:
Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the government for a redress of grievances.
